General terms and conditions of online sale

1. Scope of application
The general terms and conditions of sale (hereinafter referred to as the ‘GTC’) apply to all orders placed and contracts concluded (hereinafter referred to as the ‘order’) by any individual or legal entity visiting or making a purchase (hereinafter referred to as the “Customer”) via the online shop of Pompes Funèbres Générales Genève SA (www.pompesfunebresgenerales.ch; hereinafter referred to as the ‘Site’).
Pompes Funèbres Générales Genève SA (hereinafter referred to as ‘PFG GENEVE SA’) reserves the right to modify the GTC. The version of the GTC valid at the time of the order applies. It cannot be changed unilaterally for the order in question.
2. Conditions for placing an order
Any person placing a private order on the Site declares that they are 18 years of age and have the legal capacity or, failing this, parental authorisation to enter into the contract.
In the event that these conditions have not been complied with in accordance with what is stated in this contract and in order to resolve any dispute, PFG GENEVE SA reserves the right to contact the guardian, curator or legal representative of this person directly.
3. Offer
The offer is open to all individuals domiciled in Switzerland. Products will only be delivered to addresses in Switzerland.
The offer is valid for as long as it appears in the online shop, while stocks last. Prices and product ranges may be changed at any time.
The information appearing on the Site does not constitute an offer in the legal sense of the term, so that only the order placed between the Customer and PFG GENEVE SA constitutes such an offer.
4. Prices
Prices are quoted in Swiss francs [CHF], including all taxes applicable in Switzerland. The prices indicated in the online shop at the time of the order are binding.
If the order is delivered to the address indicated by the Customer, the cost of postage and packaging will be invoiced to the Customer in addition to the cost of the items ordered.
If the Customer collects the order from PFG GENEVE SA’s premises, the cost of postage and packaging will not be charged to the Customer in addition to the cost of the items ordered.
5. Conclusion of the contract
5.1 All Internet users can read the GTC on the Site. They are communicated during the order validation process and the registration of the order is subject to their acceptance. Any order therefore implies full and complete acceptance, without exception or reservation, of the conditions set out in this contract. Any person who has made a purchase on the Site therefore declares that he or she is fully aware of them and cannot deny this fact in the event of a dispute.
The GTC in force at the time each order is placed shall prevail.
5.2 After acceptance of the General Terms and Conditions of Sale and payment of the full sale price plus any packaging and carriage costs, the order is transmitted to PFG GENEVE SA. The order is considered to be a request to PFG GENEVE SA to enter into a contract.
5.3 Once the order has been transmitted, the Customer will receive an acknowledgement of receipt at the e-mail address provided during the order process, confirming that the order has been received by PFG GENEVE SA. Once the acknowledgement of receipt has been sent by PFG GENEVE SA to the Customer, the latter may no longer cancel the order. This e-mail constitutes PFG GENEVE SA’s acceptance of the order and thus forms the sales contract between PFG GENEVE SA and the Customer, governed by the GTC defined by the present contract.
5.4 PFG GENEVE SA may, without justification, refuse all or part of the order. In this case, the Customer will be informed and any payments already made will be refunded.
6. Means of payment
The methods of payment accepted are credit cards, payments via the PayPal and Stripe platforms, and advance payments against invoice. In the case of payment by credit card, the amount will be debited after the order has been processed. In the case of payment by invoice, the order will only be dispatched once the purchase price has been received.
7. Product availability and delivery times
The Site mentions the availability of the product as well as an estimate of the time within which the desired product is likely to be dispatched. This information varies according to the presence of the product in question in PFG GENEVE SA’s stocks and, if it is not available in its stocks, in those of PFG GENEVE SA’s suppliers. PFG GENEVE SA cannot be held responsible for this information, which is provided for information purposes only. It cannot be guaranteed as it is subject to the limits of PFG GENEVE SA’s stocks or those of its suppliers.
Despite all the precautions taken with its suppliers to obtain the most accurate information possible regarding the availability of the products offered, it may happen that one or other of them, deemed available at the time of the Customer’s order, is finally unavailable. Should this occur, PFG GENEVE SA undertakes to inform the Customer.
In the event of permanent unavailability [sold out, no longer on sale, etc.] of the items ordered by the Client, PFG GENEVE SA will be obliged to cancel the order, while suggesting a product of equivalent quality and price.
8. Delivery

The Customer’s delivery address must be in Switzerland.

When validating the order, the Customer may choose between the following two alternative delivery methods:
8.3.1 Delivery of the order to the address indicated by the Customer
This delivery option is selected by default during the order validation process.
Delivery costs depend on the weight and volume of the goods ordered. Priority is given to delivery by Swiss Post. The post office receipt is proof of delivery of the order.
If the Customer is not on site at the time of delivery, PFG GENEVE SA reserves the right to reship the order at the Customer’s expense.
Certain items are only available for collection at PFG GENEVE SA’s address: avenue Cardinal-Mermillod 46, 1227 Carouge.
8.3.2 Order pick-up at PFG GENEVE SA premises
Collection from the premises of PFG GENEVE SA, avenue Cardinal-Mermillod 46, 1227 Carouge, enables the Customer to collect his order during opening hours without having to pay the delivery charges in addition to the cost of the items making up the order.
Once this method of delivery has been chosen, it will no longer be possible for the Customer to request shipment at a later date.
Once the order has been delivered to PFG GENEVE SA’s premises, the Customer will be notified by e-mail, to the e-mail address provided during the ordering process, of the availability of his/her order. The Customer may then collect the order within 6 months of the date following this notification. After this period, PFG GENEVE SA reserves the right to dispatch the order at the Customer’s expense and to demand full payment, should the Customer fail to return the Customer’s availability to collect the order.
9. Return and exchange policy
Items ordered by the customer that are not personalized (custom-made cards, etc.) may be returned within 7 days of the delivery date, as evidenced by the deliveryman’s stamp, provided that the items are not used or damaged.
If the item ordered has been damaged in transit (i.e. the parcel has been damaged), the customer has 7 days from the date of delivery, as evidenced by the deliveryman’s stamp, to lodge a complaint with the company providing the delivery service and to inform PFG GENEVE SA of his/her wish to return the item in question.
If the item ordered does not conform to the order, provided that the item is not worn or damaged, the Customer may send a return request to PFG GENEVE SA and return it, at PFG GENEVE SA’s expense, within 7 days from the date of delivery, as evidenced by the deliverer’s stamp.
Whatever the reason for the return request, a copy of the invoice attached to the order must be enclosed with the return shipment.
The copy of the invoice and the item being returned must be sent to the following address: avenue Cardinal-Mermillod 46, 1227 Carouge.
The customer is responsible for returning the item ordered in such a way that it is not damaged in transit. If the item ordered is returned to PFG GENEVE SA damaged, the price will not be refunded.
Subject to compliance with all of these conditions, PFG GENEVE SA undertakes to dispatch the replaced item to the customer as soon as possible and at its own expense.
10. Transfer of risk
The risks of loss, damage or destruction of the product ordered are transferred to the Customer upon delivery of the order.
11. Liability
PFG GENEVE SA undertakes to do its utmost to ensure the best possible quality of service in accordance with the work carried out by all its staff and its values.
Despite its vigilance and all the precautions taken with its partners with whom it works to enable you to take advantage of the services offered, PFG GENEVE SA does not guarantee the absence of any disturbance in the operation of the Site and its various parts. Therefore:
PFG GENEVE SA declines all responsibility for any direct or indirect damage that may result from access to or use of the Site or any of its elements. Likewise, PFG GENEVE SA declines all responsibility resulting from the impossibility of accessing or using the Site.
PFG GENEVE SA also declines all responsibility for any risks associated with the installation of software that may enable consultation of the Site, or for any damage resulting from transmission errors, technical faults, overloads or interruption of communications.
PFG GENEVE SA does not accept any liability for any damage resulting from transmission errors, technical faults, overloads or interruptions of communications. You are also solely responsible for any order for an item which does not comply with the legislation of a third country into which the item ordered is imported without PFG GENEVE SA’s knowledge or which is prohibited on its territory.
12. Complaints
If products are delivered with visible damage to packaging or contents, the customer must immediately notify the deliverer and refuse acceptance, notwithstanding any warranty claims. It is imperative that the customer obtains confirmation of the damage from the deliverer. PFG GENEVE SA must also be notified immediately of any transport damage.
It is also the customer’s responsibility to inspect the products ordered immediately upon receipt. In the event of defects or deviations from the order, PFG GENEVE SA must be notified on the day of delivery either by telephone on +41 (0) 22 342 30 60 or by e-mail to agence@pfg-geneve.ch. The amount paid by the customer for the defective goods will be credited to the credit or debit card used by the customer at the time the order is finalized. PFG GENEVE SA reserves the right to require proof of defect.
13. Applicable law and place of jurisdiction
All clauses contained in these GTC, as well as in all purchase and sale transactions referred to herein, are subject to Swiss law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods.
In the event of a dispute between PFG GENEVE SA and the Customer, the place of jurisdiction for natural persons is Geneva or the Customer’s place of domicile. For legal entities, the place of jurisdiction is Geneva.

15. Protection of personal data
Regardless of the nature of the personal data concerning the Customer that PFG GENEVE SA may come into possession of, either when it is entitled to request them in the context of the present contract, or when they are collected in an automated manner, PFG GENEVE SA undertakes to make every effort to treat them with the strictest confidentiality, to ensure their protection and to use them only to carry out the Customer’s requests or to improve the services offered on the Site.
